Update after yesterday’s master hearing:
Naz’s final hearing is March 15th. Please plan to come out to Pearsall to support him!! I apologize for the previous misinformation, but Judge Crossan still has to decide whether or not to grant him the waiver to cancel his deportation, because he had 2 other misdemeanor possession charges from 2003/2005. The “aggravated felony” charge was clearly our biggest hurdle- it made him ineligible to even be CONSIDERED for a waiver. So the dismissal of his felony charge is still HUGE progress and definitely a blessing!! But yes, there is still more to be done. Sorry to postpone the celebration parade. But we need ALL of your support on March 15th to show the judge why Naz needs to stay. His character alone and all his accomplishments and growth since 2005 speak for themselves- we have a great chance of him winning simply based on that. But let’s seal the deal with all our faces in the courtroom in support!
And no, he is not eligible for bail/bond because if you’ve had ANY drug charge after 1998, no matter what drug or what amount, you are still mandatory detention. We are on the uphill climb. Don’t be discouraged. Still holding fast to Psalms 37:6.
And neither I nor Naz realized that the 2003 drug charges (2 years before he went through the treatment and began recovery) were still “on the table” or that they could affect his immigration status. We were so wrapped up in just getting the Aggravated Felony off of the table. So we are definitely shocked by this.
But God isn’t.
And don’t be fooled- I was extremely emotional about this for a while- processed through it with some friends, and I am just choosing to hold onto hope and the promise. Just wanted to shared it with you so you didn’t think I was numb/cold or that I am made of stone. I am definitely “feeling my feelings” and this is in fact quite emotional. But I will be the master of my emotions- they will not master me I know that God is still good, and that is something to rejoice about.
So the Final Hearing March 15th. The judge said that if another spot opens up before then, he will give us the opportunity to take it. AWESOME! I talked to Naz tonight and he told me that we do indeed need supporters, although the judge said we cannot wear our Free Naz T-shirts in court this time! lol. We’ll just all wear blue and purple then to show our solidarity. We could just turn our other ones inside out, or wear a jacket so just the front of the shirt is visible. haha. such a rebel.
The judge was about to just go ahead and vacate his immigration case and send him on his merry way but our attorneys advised that we need to deal with these other 2 right now so that we don’t face this later on. You only get one waiver, one shot at discretionary relief. That is the positive side of this- since these are misdemeanors, he is eligible for relief so the judge gets to use his own discretion to decide whether to let him stay. That is where all the support and our character witnesses, petition and support letters will be very useful.
I’m still just praying for God’s will to be done. And hoping that an earlier court date happens to be part of it! lol. Either way, we are so thrilled to have sight of the finish line. When he is granted the cancellation of removal, he will come home that afternoon! March 15th BE THERE.
